Atari Punk Console on Ebay Subject description: actually says "Atari Punk Console" |

$78. wow. anyway, i'm positive he used my layout because 2/3 of the links he posted had it. also, you can order from here.
i already asked him if he had the right. i'm not surprised, or even upset, i just don't think he should be making money off of Mims' circuit. not only that, but it clearly says "For personal, non-profit use only" on the layout. it's not like i have legal power, but how can we stop him from doing this without the consent of myself or Forrest Mims? |

That's what happened over here when tickets to the "Splendour in the Grass" festival sold out within a couple of days, and then immediately started appearing on e-bay for twice the price. People all over the place started signing up new e-bay accounts, (and using current ones) to put $50,000 and $100,000 bids on. It worked really well. _________________ What makes a space ours, is what we put there, and what we do there. |

I' am NOT condoning anything here but ...
He's selling a physical item that is his property, how does that infringe anything ?
Sony own the 'copyright' to the circuits in my TV, but they don't mind me selling it.
Also the "For personal, non-profit use only" thing has totally no power, it's an age-old
internet meme, I'm surprised people still use it, it's so 1998 _________________ Lots of new albums at Ambientlive |

it's mostly a moral thing. i just don't agree with it, but that's about it. that tv thing isn't a very good example though considering someone had to buy it from sony in the first place...
anyway, i guess it just makes me upset that if i ever create a badass circuit (like Forrest did), i would want to share it with you guys. it just wouldn't be safe because i would have no legal rights against people who want to make money off of it. it's a really long and old subject, i know. |

I s'pose I kind of see it the same as making music.
Do you do this thing to make money? (If you do, then you should look after your business matters a bit better)
If you don't, then you must be making money some other way, and ultimately neither you nor your children are going to starve if someone steals it and renders it unable to be "sold" again.
Are you worried that this person is going get the recognition that you deserve and make heaps of money out of it? Well don't be. They had to steal the idea from you, so when someone starts throwing mega bucks at them to follow it up, they will fail. You know the idea was yours. I know the idea was yours.
I think there was a buddhist saying which was something like; "The only real reassurance comes from within." _________________ What makes a space ours, is what we put there, and what we do there. |

the name Atari Punk Console was actually coined by Jan at Kaustic Machines... I used it on my units with permission... and by my units I mean both of them and if you'd like a piece of the action, Choc, I'll kick you down a license fee for use of your layout... this guy however, I am sure has not contacted Jan nor you about use of the name or artwork. |

Well it is claimed that he uses a design and artwork made by others to build products that he then sells, which, when true, is a copyright violation. Or stealing in other words. It's pretty hard to do something about it though.
This would be more like reverse engineering your sony, making copies, and selling those. Sony wouldn't be too happy with that. _________________ Jan

actually, both you and krunkus have misunderstood me a little. i don't think i deserve any profit for his using my layout. it was bound to happen, and i'm not surprised at all. i'm complaing here for the sake of the circuit's designer, forrest mims. IMHO, he's the one here that deserves a little bit of the pie. it doesn't even matter.
actually, i sort of like the fact that my layout has gotten that popular...

more like: sony gives you a schematic to help you fix your tv. then, you turn around and make some and sell them, putting sony out of business. |

not to be a smartass or anything, but i have to ask how it is that you know that he/she used your pcb layout? i don't see any links. also there are like 5 layouts around now and they are pretty simple to do.
and this issue came up for me back when i did this http://thesquarewaveparade.com/atri.html and then decided to sell it. i think i got like $90 for it. but i obviously didn't use your layout, mine was about the size of a matchbook, i hadn't even seen your layout. i also didn't use the name, though it did appear in the description, and i modified the circuit.
so did i do something wrong? i admit it felt kind of dirty to do, but i didn't think i could get in touch with mr. mims at the time and only found his site after the fact.
also for the record tom bugs and i did have a long back and forth over the downgrade. he's an amazing guy.

So the argument goes, I can buy the parts (similar to "someone had to buy it from sony in the first place")
and then make the circuit, which tbh, is not actually in the minimoog league,
but then when I get fed up with it, I can't sell it ?? _________________ Lots of new albums at Ambientlive |
